Last week Madonna celebrated the adoption of David Banda by partying at two of London's most high-profile restaurants for two nights in a row. But tellingly, husband Guy Ritchie, 39, wasn't with her on either night.

'She was out at Claridge's on Wednesday night on her own, then on Thursday night Madonna was at Nobu with Gwyneth Paltrow, but no Guy,' says our Nobu source. 'She was lifting her hand up to the photographers to make it clear she didn't have a wedding ring on.'

Publicist Liz Rosenberg insists 'Mr and Mrs Ritchie remain happily married' but As NOW revealed in March, the 7-year marriage is now at an amicable end and insiders say the couple are close to going public with their split.

'Madonna and Guy have actually been living pretty much separate lives since early this year, but they remain committed to having an amicable break-up for the sake of their children,' says our source. 'She's been through a lot of anxiety with the adoption and didn't want to risk losing David.'

The couple have made plans to sell Ashcombe House, their £12 million, 1,200-acre home in Wiltshire and Madonna's set to move to New York for good as soon as she can.

Naturally, I posted this to get verification from our own NOW magazine insider, johnnox. So which is it? Is Madonna getting a divorce or is it all tabloid bs?

Nor me. They probably stayed together until the adoption finally went through. I guess the next few weeks should reveal all.

exactly. there've been seperation rumours for quite a while and it seemed reasonable they were acting as a happy couple for the sake of little david. as the adaption is now certified, it'll only be a matter of time before they announce their split.

it's sad alright. the only difference is, she may end up single again, but at least she won't be alone. she has three childern to love her.

could anyone not see this coming? his career nosedived right after their marriage, and it must have been really hard for him to live under his wife's shadow. less we not forget that however great she may look, there is a 10 years gap between them.

I think this is good news. Guy Ritchie was a 1 hit wonder and his early hit films while reasonable are certainly not classics.

Sources have suggested that Guy and Madonna do not have a pre-nuptial agreement in place, which would leave Guy eligible to walk away with up to half of Madonna’s fortune. According to Forbes magazine, the Queen of Pop earned $72 million last year alone.

Although there has been persistent rumours of a growing rift between the couple, a divorce will come as a shock to many, if the rumour of proceedings transpires to be true.

The source told Holy Moly that a simple ‘growing apart’ is behind the rumoured split. The couple have increasingly spent time apart, with Madonna’s tour and promotion for her new album, Hard Candy, keeping her away. The drawn-out adoption of little David Banda, which has just been finalised after two years, is also thought to have caused tension between the couple, who also have a biological son, Rocco, together.

Madonna’s meeting with Moyston reportedly took place ten days ago. A rep has yet to comment on the rumour.

She's American with either a New York or Calfornia domicile, he's English and they married in Scotland. Pre-nuptial agreements are void in English and Scots law. The fact that they've been living in England for most of the past decade with properties here would probably give the English courts jurisdiction. On the face of it, both Guy and Madonna could be argued to have an English domicile.

For Guy to automatically get half the value of their property and earnings throughout the duration of the marriage, he'd have to try to bring the case into a jurisdiction which has a community property approach, like California. England doesn't have community property law so Guy wouldn't be automatically entitled to half, and it's unlikely he'd be able to convince the California courts to take jurisdiction, the English courts seem the most appropriate.

Then again, stranger things have happened.

Yeah, he really doesn't seem the type to try and fleece her, especially as the whole thing appears quite amicable. I mean it was only a few weeks ago that they were arm-in-arm at Cannes infront of the press. Things must be quite friendly between them.
